第二十三章 居間合同
第四百二十四條 居間合同是居間人向委托人報(bào)告訂立合同的機(jī)會(huì)或者提供訂立合同的媒介服務(wù)，委托人支付報(bào)酬的合同。
第四百二十五條 居間人應(yīng)當(dāng)就有關(guān)訂立合同的事項(xiàng)向委托人如實(shí)報(bào)告。
居間人故意隱瞞與訂立合同有關(guān)的重要事實(shí)或者提供虛假情況，損害委托人利益的，不得要求支付報(bào)酬并應(yīng)當(dāng)承擔(dān)損害賠償責(zé)任。
第四百二十六條 居間人促成合同成立的，委托人應(yīng)當(dāng)按照約定支付報(bào)酬。對(duì)居間人的報(bào)酬沒有約定或者約定不明確，依照本法第六十一條的規(guī)定仍不能確定的，根據(jù)居間人的勞務(wù)合理確定。因居間人提供訂立合同的媒介服務(wù)而促成合同成立的，由該合同的當(dāng)事人平均負(fù)擔(dān)居間人的報(bào)酬。
居間人促成合同成立的，居間活動(dòng)的費(fèi)用，由居間人負(fù)擔(dān)。
第四百二十七條 居間人未促成合同成立的，不得要求支付報(bào)酬，但可以要求委托人支付從事居間活動(dòng)支出的必要費(fèi)用。
附 則
第四百二十八條 本法自１９９９年１０月１日起施行，《中華人民共和國(guó)經(jīng)濟(jì)合同法》、《中華人民共和國(guó)涉外經(jīng)濟(jì)合同法》、《中華人民共和國(guó)技術(shù)合同法》同時(shí)廢止。
